The Public Records Act exempts from disclosure an attorney’s work product, as well as the privileged communication between an attorney and their client. In order to assert these exemptions, public records practitioners must first have a strong understanding of the meaning of these terms in the unique public records context. Working under the direction of their agency attorney, practitioners must then determine whether or not to assert the exemption.
