The Public Records Act (PRA) includes exemptions for information the disclosure of which would violate an individual’s right to privacy. However, the statutory definition of “privacy” is narrow and often conservatively interpreted by the courts. Recent judicial decisions have explored broader constitutional privacy protections, adding complexity to how agencies handle sensitive records. Records practitioners, in collaboration with agency attorneys, should be able to identify statutory privacy protections, flag potential constitutional privacy concerns, and determine when third-party notice is appropriate.
