Webinar Overview:

The First Amendment prohibits government from making laws "respecting an establishment of religion," but what does that mean? Until recently, courts have interpreted the Establishment Clause broadly to prevent "excessive government entanglement with religion." However, a recent US Supreme Court case jettisoned “excessive entanglement” and deemphasized the role of the Establishment Clause in limiting governmental action. We will explore how this shift affects Washington local governments in areas such as religious expression in the workplace, display of religiously themed art and monuments, and legislative prayer.

Educational Objectives:

This webinar will help you understand the following:

  • The requirements imposed by the Establishment Clause on local governments and how the Establishment Clause relates to First Amendment rights, such as freedom of speech and free exercise of religion.
  • The role of the government speech doctrine and what types of things a local government can say about religion.
  • Common pitfalls that local governments may face when assessing establishment clause issues.
  • How to minimize liability exposure in Establishment Clause matters.

Presenters:

  • Oskar Rey, Legal Consultant, MRSC.
